In a move that could upset business owners in a state that is home to some of the country’s largest breweries, the state Legislature is moving to eliminate the licensing requirements for brewpubs.

The bill, H.B. 2109, is sponsored by State Sen. Tom Apodaca, D-Auburn Hills, who said the state law is outdated and doesn’t allow for large businesses to exist, because large breweries take too much time, money and labor to run.

“It makes sense that a brewer can make beer with the best ingredients and know-how, but then if you decide that you want to sell it, you can do so at a storefront,” he said.

For years, the only restrictions that would prevent a brewery from operating were those outlined in the Alcoholic Beverage Control Act, which dates back to 1982. The laws have remained largely unchanged. Under the current law, a brewpub can only sell four beers per day and can only brew at the business for six months.

Brewpub owners have a few options.

First, they can seek a license from the state, but that application would take anywhere from four months to two years, depending on the complexity of their business, says Bob Kneebone, a spokesman for the Alcohol and Tobacco Tax and Trade Bureau. The final decision rests with the Alcohol and Tobacco Board of State Regents, where licensing is made. Then, if a brewpub licenses to sell beer, it also has the option of becoming a hotel. Beer is currently sold in six-packs at the bar, but the brewpub could sell bottles as well as cans and growlers.
