(4) Should a Muslim marry a non-Muslim?
In general, the general opinion is that he should not marry a non-Muslim. The following are some of the arguments that are used in favor of this ruling:
The Prophet said, “Whoever leaves a woman without saying her name is like one who leaves food without paying the bill.” The Companions of the Prophet (may Allah be pleased with them) said, “He leaves it like he does not like it.” He said, “Allah, His servants and those on whom He will accept are merciful to a needy.” (Reported by Muslim)
Another important issue in this regard is the concept of habilit (willingness) for marriage. Muslim jurists agree that there is this concept in regards to what is permissible and what is not permissible. There is an argument that Muslims should not marry a non-Muslim because of the negative aspects of this way of thinking and because the Prophet (may Allah be pleased with him) said, “Whoever leaves a woman without saying her name is like one who leaves food without paying the bill.” And so it seems it is prohibited for a Muslim to marry a non-Muslim even if they are of the same sex. This is because the Prophet (may Allah be pleased with him) said, “Allah, His servants and those on whom He will accept are merciful to a needy.”

(5) Is it permissible to buy a male or female non-Muslim slave?
We have mentioned the ruling of the Shafi’i School in this section. It is the only school of Hanafis that it is permissible to buy a male or female non-Muslim slave. This is because they agree with the majority opinion and they believe that a female slave who has a husband is a concubine to him. The Hanafis say that it is haraam to have sex with a female slave; however, the ruling is less harsh than what some other schools (such as the Maliki Shafi’i School) apply.
