One of the oldest and most prominent Republican politicians in the nation is being investigated for alleged illegal payments to a lobbyist last week who allegedly funneled some of the money to an aide’s husband.

According to Politico, Rep. Steve Scalise (R-LA) is “in custody” pending a possible charge of “willfully and knowingly” violating federal law, the same charge that Senator Robert Menendez (D-NJ) faces at the federal level.

Politico says it’s not clear why Scalise hasn’t faced federal charges for the alleged payments to John Whitbeck, but the Washington Examiner reports that the FBI obtained an agreement this week with another lobbyist with ties to Scalise’s office regarding that case. A source familiar with the deal says it would have been a violation if the payment continued. The FBI also sought and was granted immunity from prosecution for another lobbyist under investigation, according to the Examiner.

A spokesperson for Scalise did not respond to MSNBC’s request for comment about the allegations.

UPDATE: Scalise spokesman Matt Rittereiser says that all payments made from the committee’s office to Whitbeck ended in December.
